Sebastian Deck & Fence is a contractor providing residential outdoor construction services in Sebastian, FL and surrounding communities. Our services include, but are not limited to, custom deck design and construction, composite and wood deck installation, fence installation, pergola construction, screened-in porches, covered decks, and related outdoor structures.
All services are provided in accordance with applicable Florida building codes and local permit requirements. The specific scope of any project is defined in the written contract or proposal agreed to by both parties before work begins.
We provide free on-site estimates for prospective customers. All estimates are provided in writing and itemize the scope of work, materials, labor, and applicable permit fees to the extent known at the time of estimate. Estimates are not binding contracts.
Final pricing is established in the written contract signed by both parties. We will notify you in writing of any change to the agreed scope of work or price before proceeding with changes. Changes to the project scope requested by the customer after the contract is signed may result in a change order with adjusted pricing and timeline.
Permit fees, inspection fees, and other government-imposed charges are passed through at cost. We do not mark up permit fees.
Construction start dates are estimates. Scheduling is subject to permit approval timelines, material availability, weather conditions, and the scheduling of prior projects. We will communicate any anticipated delays in a timely manner.
If you need to cancel or postpone a scheduled project, please notify us as soon as possible. Cancellations made after a permit has been submitted may result in fees to cover permit application costs already incurred. Any deposit paid may be non-refundable if materials have been ordered or work has commenced, as specified in your written contract.
We reserve the right to reschedule work due to unsafe weather conditions, including tropical storm or hurricane warnings issued for the project area.
Payment terms are established in the written contract for each project. Typical payment schedules require a deposit upon signing, progress payments tied to project milestones, and a final payment upon satisfactory completion of the work. Specific percentages and milestones are defined in the individual contract.
Payments not received by the agreed due date may accrue interest at the maximum rate permitted under Florida law. We reserve the right to suspend work on a project if payment is not received as agreed.
In the event that collection efforts are necessary to recover unpaid amounts, the customer agrees to be responsible for reasonable collection costs, including attorney fees, to the extent permitted by applicable law.
We obtain all required building permits for projects that require them under Indian River County and applicable Florida building regulations. The customer is responsible for disclosing any known HOA restrictions, deed restrictions, or other private encumbrances that may affect the project before a contract is signed.
We are not responsible for delays or costs arising from HOA or covenant restrictions that the customer failed to disclose prior to contract execution.
We stand behind our workmanship. Any warranty on labor and workmanship is as specified in your written contract. Material warranties are provided by the respective manufacturers and are passed through to you. We do not extend any additional warranty beyond what is stated in the written contract and applicable manufacturer documentation.
Warranties do not cover damage caused by misuse, neglect, modification, unauthorized repair, acts of God, severe weather events, or conditions outside our control.
The website at sebastiandeckandfence.com and all content on it are provided "as is" without any warranty of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose.
To the fullest extent permitted by applicable law, Sebastian Deck & Fence shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to our services or the use of our website, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to a specific project shall not exceed the total amount paid by you for that project. This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.
If a dispute arises between you and Sebastian Deck & Fence relating to our services or these terms, we ask that you first contact us directly to attempt to resolve the matter informally. Most issues can be resolved through a direct conversation.
If informal resolution is unsuccessful, any dispute shall be resolved through binding arbitration in Sebastian, FL, in accordance with the rules of the American Arbitration Association. You waive the right to a jury trial or to participate in a class action. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in the state or federal courts located in Indian River County, Florida.
We may update these Terms and Conditions at any time. Changes will be posted to this page with an updated effective date. Your continued use of our website or services after any changes constitutes acceptance of the updated terms. We encourage you to review this page periodically.
